Commercial waste refers to the waste that is created by a business. There are several things that commercial waste does include, but anything that is created by households or industrial practices is not included. The exception to this is work created from gardening, but only if the gardener is not the homeowner.

The following processes are all the ways that commercial waste is considered to be created. If any of this applies to you and your business, then you must ensure that it is disposed of legally.

The following processes are all the ways that commercial waste is considered to be created. If any of this applies to you and your business, then you must ensure that it is disposed of legally.

  • Waste that is created at a rental property by a landlord or their agent.
  • Waste left behind at a residential property by builders or contractors.
  • Waste that is collected from a property to be disposed of under a commercial arrangement.
  • Waste from a residential property that is taken to a recycling centre by someone other than the homeowner.
  • If you run your own business from home then waste from this business will be considered commercial waste.
  • Any other type of waste that is listed in the Controlled Waste Regulations 2012.

You need to make sure as a business owner that you are disposing of waste correctly as this is a legal obligation. There is a Duty Of Care Legislation which will give you all the information that you need to store and dispose of waste, and about the records that need to be kept.

You will need to register as a waste carrier if you are disposing of your commercial waste in the UK. Many businesses will not need to do this because they will use a specialist company. If you are using another company to dispose of your waste, then there are certain things that you will need to think about.

The Environment Agency keeps a register of all companies that are licensed to carry commercial waste, and so you should always check that the company you are using is on this register. You should also check that they will be disposing of the waste at a licensed recycling site.

When you pass over the waste to the carrier, then you should provide details about the type of waste that they are taking on a transfer. This document should be signed by both you and the waste carrier. There will also be a declaration that you have used the waste hierarchy when disposing of waste that you will need to make sure that you sign.

If the waste is being stored on your premises before it is collected, then there are some guidelines that you need to follow. It should be stored in containers that can not be opened by animals, and that will prevent contamination of the area that it is stored. If you do have any hazardous materials that you need to dispose of, then it is very important to make sure that the company you use can transport and dispose of this waste safely.
